And the Transferee doth hereby for the benefit of the land comprised in D.P. 249072 covenant with the the Transferor

(a) That no earth, stone, gravel or trees shall be removed or excavated from each lot burdened except where such removal or excavation is necessary for the erection of a building or structure or for the safety of the occupants or the prospective occupants thereof.

(b) No main building shall be erected on the subject land at a cost or less than TWELVE THOUSAND ($12.000.00) and no main building shall be constructed of materials other than new materials.

(c) No toilet closet shall be erected on the subject land other than an Internal closet attached to and forming part of a main (building erected thereon and connected to sewer or septic system.

(d) No main building shall be erected on the subject land for use other than as a dwelling house and no building erected on the subject land shall be used as a public house, hotel or place for sale of wine or beer or Piggery poultry farm, feed lot or dog or cat kennels or for any noxious or offensive trade or for any other purpose which shall damage or be a nuisance or annoyance te the owner or occupier of the adjoining land or to the neighbourhood.

The benefit for the foregoing covenants shall be appurtenant to all the land In Deposit Plan No. 249072.

The burden of the foregoing covenants Is upon the land hereby transferred.

The foregoing covenant may be released, varied or Modified by the Vendors or the Registered Proprietors for the time being Of the residue of the land in Deposited. Plan No. 249072.
